Paternity In order to obtain a child support order, or to establish visitation rights, a paternity order must first be obtained by a Court of competent jurisdiction. Paternity may be established by acknowledgement or by DNA, which should not be confused with whether a parent has been named on the child’s birth certificate. The Illinois legislature has established the Illinois Parentage Act which sets forth the law in paternity cases. Additionally, the Illinois Supreme Court Rules, the Illinois Domestic Violence Act as well as the Illinois Appellate and Illinois Supreme Court cases interpreting those statutes apply. Also, the areas of the Illinois Marriage and Dissolution of Marriage Act that cover custody, visitation, and child support are incorporated into the Parentage Act and therefore are applied. The Law Office of Danelle W. Oilschlager is experienced in handling many types of family law cases including divorce, legal separation, establishing paternity, related adoptions, orders of protection, custody disputes, and child support. I represent clients in Kane County, McHenry County, DuPage County, Lake County and Cook County (Rolling Meadows.)
