Some people may only encounter our justice system because of a speeding ticket or similar traffic-related matter. Yet that one ticket may have a significant impact on a person’s driving record, insurance, or livelihood if it is not handled properly. Likewise, a person charged with a crime, whether it is their first offense or not, may be facing consequences with far-reaching ramifications on their life if they do not know the rights afforded to them by the United States and Illinois Constitutions as well as the laws of the State of Illinois. 

My previous experience working for the Kane County State’s Attorney’s Office has given me the opportunity work both sides of the courtroom. I have prosecuted traffic and misdemeanor cases and have insight into how the prosecution considers and approaches some cases. I have also defended clients in traffic tickets, misdemeanor matters, DUI’s, juvenile delinquency cases, and felonies. I am familiar with the various pre-trial diversion programs available in the counties where I practice.   

Know Your Rights
Our criminal justice system is truly remarkable in that the State has the complete burden of proving a defendant’s guilt beyond a reasonable doubt. That means that it is up to the government to prove each and every element of the offense that the defendant is charged with.  This applies to petty offenses such as a speeding tickets as well as felonies.  

In some cases it can become clear after reviewing the evidence that the State will be able to meet their burden of proof against a defendant. In those cases, a defendant needs an attorney who can negotiate on their behalf to try and minimize the criminal penalties they may be facing within the parameters of the law. However, in other cases it is necessary to hold the State to their burden of proof and to proceed with a trial, whether it is with a judge or a jury, which is every defendant’s right.
